Who’s Who:
- You / Client / Customer: You, the individual or business engaging with our services.
- TrustLocal Digital / Company: The provider of those services.
- Terms: The collective policies governing our relationship.
Commitment to Compliance: Using our services means you’re on board with these terms, aligned with applicable laws and industry standards. If not, you must immediately cease using the TrustLocal Digital Services.
Website Service Agreement (“WSA”)

This agreement outlines the terms and conditions under which TrustLocal Digital will provide Website Services to the Customer.
Scope of Services
TrustLocal Digital will construct a website based on the onboarding intake and discovery documents provided by the Client, as well as our initial project planning that facilitates the discovery process and as described in the Master Service Agreement (MSA).
The Customer will not have administrative access to edit web pages but can create an unlimited number of blog pages at any time using the content management system after the completed project.
Our Managed WordPress Website Service is a complete solution that covers all aspects of website creation, updates, maintenance, and backups. This means that the Customer can relax while TrustLocal Digital handles all the technical details. Our team of experts is dedicated to ensuring that the website is always up-to-date, secure, and running smoothly, including regular security updates to protect the website and its data from potential threats.
The term “Website Services” refers to the building and management of a website for the Customer by TrustLocal Digital. This includes the design, creation, updates, maintenance, and backups of the website based on the description and direction provided by the Customer. The services offered by TrustLocal Digital are comprehensive, covering all aspects of website creation, and its team of experts is dedicated to ensuring that the website is always up-to-date, secure, and running smoothly.
Our Commitment to Satisfaction: At TrustLocal Digital, we prioritize our clients’ satisfaction above all else. We understand the importance of a website to your business, and we’re committed to delivering a product you’re proud of. Here’s our promise to you:
- Design Revisions: We offer 3 design revisions to refine your website within the agreed scope. We’re committed to delivering a result you’re proud of and will work collaboratively with you throughout the process.
- Web Accessibility: Websites are designed and built with reference to WCAG 2.1 Level AA guidelines. Client acknowledges that no development process guarantees legal compliance with the Americans with Disabilities Act or any other federal, state, or local accessibility law. TrustLocal Digital makes no warranty of ADA compliance and is not liable for any accessibility-related claims, demand letters, or legal action brought against the Client or their website.
- All-Inclusive Service: Hosting, Security, Accessibility, & Reports are all included in all plans ensuring a comprehensive solution for your online presence.
- Domain Name Registration: The Client is responsible for registering and maintaining their own domain name. TrustLocal Digital can provide guidance on domain registration but does not manage or bill for domain services directly.
- Domain & DNS Management: Client’s domain must be pointed to TrustLocal Digital’s designated nameservers. TrustLocal Digital exclusively manages all DNS records. No third-party access to DNS settings will be permitted.
Customer Obligations
- Complete any questionnaires required by TrustLocal Digital.
- Ensure the accuracy of materials provided by TrustLocal Digital.
- Approve the content of pages created by TrustLocal Digital.
- Respond promptly to requests needed for the project to progress in a timely manner.
- Maintain the blog pages created by customer.
Customer’s License and Rights
The Customer grants TrustLocal Digital and its vendors and subcontractors the necessary rights and licenses with respect to the Customer’s Website or logo created by TrustLocal Digital to fulfill its obligations under this Agreement. TrustLocal Digital may make a reasonable number of backup copies as deemed necessary.
Third-Party Agency Collaboration Policy
TrustLocal Digital provides a fully managed, premium service to our clients. As part of our commitment to maintaining the quality and integrity of our services, we do not offer support, integration, troubleshooting, or coordination with third-party marketing agencies. Clients who choose to engage external agencies for services such as paid media, SEO, or other marketing activities are solely responsible for any conflicts, tracking issues, or performance discrepancies that may arise. TrustLocal Digital will not adjust our services, including but not limited to website updates, SEO strategies, or reporting, to accommodate third-party campaigns. Furthermore, we do not install, manage, or troubleshoot third-party tracking codes or pixels provided by external agencies. Our performance guarantees and service commitments apply exclusively to services directly managed by TrustLocal Digital.
Support
TrustLocal Digital’s dedication to client success extends beyond the initial website design and deployment phase. The managed services described in the Master Service Agreement (MSA) encompass a comprehensive support structure, ensuring client websites remain updated, operational, and in line with their business objectives.
For extensive website revisions that fall outside this scope as defined in the MSA are governed by an Addendum to the MSA, Change Order Form (COF) will be provided and quoted by TrustLocal Digital.
Operational Hours & Response Commitment: For details on operational hours and response times, kindly refer to the SLA under our “TrustLocal Digital Responsibilities” section.
TrustLocal Digital values client feedback and remains unwavering in our commitment to deliver exceptional support. We aim to ensure that our clients’ online platforms epitomize excellence. Should there be any questions or need for clarification regarding our support structure, clients are strongly encouraged to reach out.
Change Order Form (COF):
All specialized services are billed with a minimum of one hour. Subsequent time is billed in half-hour increments. For example, a task taking 1 hour and 20 minutes will be billed for 1.5 hours.
For certain tasks, depending on their complexity and size, TrustLocal Digital may provide a COF outlining the specific deliverables, timelines, and associated costs. In such cases:
For smaller tasks where a COF is deemed unnecessary by TrustLocal Digital, the client will be billed upon the task’s completion. It remains at the sole discretion of TrustLocal Digital to determine the necessity of a COF based on the size and complexity of the task.
Content Management
- Website Content: The Customer acknowledges that TrustLocal Digital provides a managed website service, where the design and content creation is handled by TrustLocal Digital. If requested, the Customer may add, edit, and delete blog content using the easy-to-use editor provided by TrustLocal Digital and may only add HTML content and upload images. All other pages and content will be provided and managed by TrustLocal Digital as directed by Client.
- Editor Usage: The Customer agrees to use the editor in accordance with the terms and conditions outlined in this agreement. Modifications or changes made outside of the editor may result in the loss of content or affect website functionality.
- Responsibility: The Customer understands that any content they add, edit, or delete through the editor is their sole responsibility. TrustLocal Digital will not be held liable for errors or inaccuracies in the content added by the Customer.
- TrustLocal Digital does not guarantee SEO or conversion outcomes from customer-created blog content. Performance is influenced by the quality, relevance, and technical accuracy of the material provided by the Client.
Ownership of Customer’s Content
- Customer acknowledges that all Content provided by them to TrustLocal Digital for inclusion on the Website, is owned by the Customer or that they have a legal right to such Content.
- Customer is responsible for ensuring that all Content and its use do not violate the TrustLocal Digital Acceptable Use Policy (AUP).
- Customer is responsible for any and all claims related to the Content.
- TrustLocal Digital will not be responsible for any legal issues related to the Content.
- DMCA Compliance: The Customer agrees that if any content on the website infringes upon third-party copyrights, and TrustLocal Digital receives a valid DMCA takedown notice, TrustLocal Digital may remove the affected content without notice or liability.
Website Ownership and Buyout
Customer may elect to purchase full ownership of the website at the end of any contract term. Upon completion of a buyout, Customer will receive full ownership of the website, including its content and associated assets. Customer assumes full responsibility for hosting, security, updates, and ongoing maintenance. Plugin licenses are excluded and must be obtained separately by Customer.
Buyout Fee Structure
- After 12 months – pay remaining 24 months of website fees
- After 24 months – pay remaining 12 months of website fees
- After 36 months – ownership transfers at no cost
Payment Conditions:
The Customer must be current on all payments and not in default of the Agreement to exercise the buyout option. The buyout fee must be paid in full before ownership is transferred unless otherwise agreed upon in writing by TrustLocal Digital.
Ownership Model:
The website is provided under a lease-to-own model and remains the property of TrustLocal Digital until ownership is earned through either completing 36 months of service or choosing to buy it out early. Once either condition is met, full ownership transfers to the Customer.
Termination & Data Handoff
Upon termination of this Agreement, the following conditions apply:
- If Client has earned or exercised ownership, full website ownership transfers per the Website Ownership and Buyout section above.
- If Client terminates prior to earning ownership, the website will not be transferable.
- Site migration is a billable service. A migration fee of $249 applies upon request.
- Website files are retained for 30 days following termination, after which all data may be permanently deleted.
- Plugin licenses are non-transferable. Upon handoff, Client is responsible for obtaining their own licenses. A list of required plugins is available upon request.
- TrustLocal Digital does not provide support following termination.
TrustLocal Digital Footer
- Customer agrees that the text and/or image footer link “Site by TrustLocal Digital” will appear on the completed site. The customer may choose to exclude or permanently remove the footer from its website at any time, subject to an additional one-time payment to TrustLocal Digital in the amount of $359.00 USD. This payment may be made at any time after the website has launched. The footer will be removed within 3–5 business days of confirmed payment.
Disclaimer
TrustLocal Digital may update these Terms or related policies at any time. Updates will be communicated to registered customers by email and posted on our website. Your continued use of our site and services after such updates constitutes acceptance of the revised Terms.
TrustLocal Digital provides its website and services “as is” and makes no warranties, express or implied, regarding their accuracy, reliability, or availability. We are not liable for any indirect or consequential damages arising from the use or inability to use our services, except as required by law.
