Terms of Service (“TOS”)

Welcome to TrustLocal Digital’s Terms of Service. By using our services, you agree to the following terms. These are intended to set clear expectations and ensure proper usage. Contact us at support [at] TrustLocal Digital.co with any questions. 

Account Terms

  • You must be 18 years or older to use our services.
  • TrustLocal Digital will communicate with you primarily through the email address and/or phone number you provide.
  • You are responsible for keeping your passwords secure.
  • You are responsible for all materials handled through your account.
  • Violations may result in immediate account termination.

General Conditions

  • You must agree to all terms listed at https://trustlocaldigital.com/legal/.
  • Support is only available to paying account holders and their authorized contacts.
  • Support hours: Monday–Friday, 9 a.m.–6 p.m. EST.
  • Support requests must be submitted through the Help Desk.
  • Calls may be monitored and recorded.
  • Email support tickets will be addressed within 24–48 business hours.
  • Email hosting is not supported.
  • TrustLocal Digital DNS servers are required for services.
  • Clients are not charged for open-source software but may pay for setup or customization.
  • All users must comply with TrustLocal Digital’s Acceptable Use Policy (AUP), which outlines prohibited content and activities

Fees & Payment Terms

  • Fees are due at sale and billed monthly on the anniversary date.
  • A 5% late fee applies to invoices overdue by 10 days. After 15 days, services may be suspended. At 27+ days, accounts may be terminated and all data deleted.
  • Contact TrustLocal Digital within the grace period to discuss payment issues and avoid disruptions.

Cancellation/Termination of Services

Bundled Services Notice: TrustLocal Digital services are provided as a bundled managed solution. Cancellation of any core service (e.g., website hosting, SEO, or site management) constitutes termination of the entire service bundle and will initiate the account deactivation process, including coordinated removal of services and termination of access credentials. If applicable, clients may request a website buyout  per the Website Service Agreement (HSA).

Most services are monthly with a 30-day cancellation notice. Refer to your MSA for details.

  1. Full Refund Guarantee (7-day grace period): New customers can request a full refund within the first 7 days.
    • Refund Amount: Credit card fees will be deducted. A refund breakdown can be provided.
    • Claiming the Refund: Contact your representative within the 7-day window.
  2. Custom Website Design and Development: May include term commitments outlined in the MSA.
  3. PPC Management Services: Month-to-month, with 30-day cancellation notice.
  4. Other Marketing Services: Auto-renew unless canceled with 30-day notice before the term ends.
  5. Website Management Services: Cancellation requires fulfillment of all marketing obligations and site migration.

TrustLocal Digital may terminate services immediately in cases of disparagement, legal risk, or overdue maintenance. Accounts may also be terminated without notice if overdue.

Refunds

Refunds are only available within 7 days of purchase and are subject to deduction of applicable payment processing fees. After 7 days, all sales are final and no refunds will be issued for one-time or recurring charges.

Disclaimer of Warranties

Services are provided “as is” with no warranties. TrustLocal Digital is not liable for errors, omissions, or limitations in service access or functionality.

Limitations of Liability

Liability is limited to one month of service fees. No liability for indirect or consequential damages.

Indemnification

You agree to indemnify TrustLocal Digital against claims arising from misuse or violation of these terms. TrustLocal Digital may control legal defense and you must cooperate.

Force Majeure

TrustLocal Digital is not liable for delays or service interruptions due to events beyond its control.

No refunds or compensation are provided for interruptions caused by force majeure events.

Copyright & Trademarks

You must own or have rights to all content provided to TrustLocal Digital. You agree to defend TrustLocal Digital from any related claims.

Governing Law

These terms are governed by Tennessee law, regardless of client location.

Dispute Resolution

Disputes must first go through direct negotiation, then mediation, and finally binding arbitration in Hamilton County, TN, per AAA rules. No jury trial or class actions.

Either party may request a written summary of issues and proposed resolutions before mediation begins. To start mediation or arbitration, contact support[@]trustlocaldigital.com.

TrustLocal Digital may update these Terms or related policies at any time. Updates will be communicated to registered customers by email and posted on our website. Your continued use of our site and services after such updates constitutes acceptance of the revised Terms.

TrustLocal Digital provides its website and services “as is” and makes no warranties, express or implied, regarding their accuracy, reliability, or availability. We are not liable for any indirect or consequential damages arising from the use or inability to use our services, except as required by law.
